Terms Of Service

This Terms of Service Agreement (“Agreement”) is entered into by and between Bytek (Pty) Ltd. (hereafter referred to as “Bytek). By accessing or using our website and services, you agree to be bound by these terms.

Website Design, Graphic design & Internet Marketing

All Web Design & Development and Ongoing services provided by Bytek are subject to the following terms and conditions:

1. Estimates:

Estimates provided quotation will be honored for 30 days. A new quote will then be provided upon request.

2. Charges & Fees:

2.1 Web Design Packages:

All new web design projects require an initial 30% deposit, due when accepting the order. The remaining 70% balance is due upon acceptance of the completed web design project before it is released or published. Bytek retains the right to hold graphics and project development until payment is received.

3. Payments:

Bytek accepts payments via EFT. Projects will not be released or uploaded until full payment is received.

4. Hours of Operation:

Our business hours are Monday to Friday from 9:00 am to 5:00 pm. Website/hosting support is available 24/7 via ticket support.

5. Website Design Credit:

All Bytek web design clients will have a “Designed by: Bytek” link on their website footer. 

6. Copyright & Ownership:

Upon project completion, Bytek transfers all rights and ownership of CUSTOM designs and programming to the client. Software and third-party graphics or programs remain under their respective owners’ copyright. Bytek reserves the right to resell unpaid custom-designed websites or graphics. Bytek may display designed websites and graphics for promotional purposes.

7. Refunds:

A 30% deposit is required before project work begins. A service termination request must be in writing. Bytek has a Guaranteed 30 Day Turnaround. If the project is not completed within 30 days, and all required content is provided, a half-deposit refund is issued within 30 days of the request.

Refunds, processed within 30 business days, do not apply to SSL certificates and domain services. Hosting services carry a 30-day money-back guarantee if purchased separately. No refunds for administrative fees, install fees, or violated terms.

8. Chargebacks:

Bytek will not negotiate chargebacks. Refund policies are stated clearly, and clients must agree to terms before project commencement.

9. Development & Delivery:

Bytek commits to completing web design projects within 30 days from the first deposit. If the client fails to provide required content within 30 days, the contract becomes void. Project extensions may be requested in writing for an additional fee.

10. Non-Communication:

If unable to communicate with a client for 14 days during the design process, the project will be canceled without refund.

11. Liability:

Services are provided “as is” without warranty. Bytek is not liable for direct, indirect, or consequential damages arising from website use.

12. Acceptance:

By submitting a deposit, clients agree to all terms. Bytek reserves the right to change terms without prior notice.

13. Ongoing Support & Internet Marketing Services:

Subject to the above terms, paid on a yearly, monthly, or hourly basis per the original estimate(s).

14. User Agreement & Hosting Terms of Service:

The use of services from Bytek constitutes an agreement to these terms.

14.1 Account Setup / Email on File: We will set up your account before creating your order. You must provide an email address not using @ the domain(s) you’re signing up under. The primary email on file will be used for communication. Ensure it is current to avoid potential issues.

14.2 Transfers: Our transfers team will make efforts to assist you in moving your site to Bytek. While we strive to help, guarantees on transfer availability, possibility, or time cannot be provided. Specific details for website transfers can be obtained by contacting us.

14.3 Content: All services provided by Bytek must be used for lawful purposes. Clients agree to indemnify and hold Bytek harmless from any claims resulting from service use. Prohibited activities include copyright or trademark infringement, sale of counterfeit merchandise, and hosting of illegal content.

14.4 Zero Tolerance Spam Policy: Bytek has a zero-tolerance stance against unsolicited e-mail, bulk emailing, and spam. “Safe lists” and “double opt-in” will be treated as spam. Users sending spam will have their account terminated. Sites advertised via spam may not be hosted on our servers.

14.5 Payment Information: Clients agree to provide appropriate payment for services in advance. Services will be billed on a recurring basis until canceled. It is the client’s responsibility to ensure payment information is up-to-date.

14.6 Backups and Data Loss: Your use of the service is at your risk. Bytek is not responsible for files and data residing on your account. Clients are responsible for maintaining appropriate backups.

14.7 Cancellations and Refunds: Bytek reserves the right to cancel accounts at any time with or without notice. Abuse of staff may result in service suspension or termination. Clients may terminate services on 30 days’ notice. There are no refunds on administrative fees, install fees, SSL certificates, or domain name purchases.

14.8 Shared Servers: Shared accounts may not resell web hosting to others.

14.9 Price Change: Bytek reserves the right to change prices and resource allocations at any time.

14.10 Indemnification: Clients agree to defend and indemnify Bytek against any demands, liabilities, and claims arising from service use.

15. Disclaimer:

Bytek shall not be responsible for any damages. No warranties are provided for services, and Bytek disclaims merchantability or fitness for a particular purpose.

16. Disclosure to Law Enforcement:

Bytek may disclose subscriber information to law enforcement agencies upon lawful request.

17. Changes to the Terms of Services:

Bytek reserves the right to revise its policies without notice.
